Terms of Service

1. Acceptance of Terms

By accessing or using the Encludo platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Encludo provides an AI-powered web accessibility widget, analytics dashboard, and related services. The Service includes a free tier and paid subscription tiers (Pro and Enterprise).

3. Service Components

Encludo is a proprietary accessibility platform. The hosted widget, AI backend, dashboard, and all associated assets are owned by Encludo and made available to you under these Terms. No right to redistribute, reverse-engineer, or self-host the widget source is granted.

4. Account Registration

To access paid features and the dashboard, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to circumvent usage limits or rate limiting
  • Reverse engineer the proprietary backend services
  • Resell the Service without a partner agreement
  • Use the Service to process or store sensitive personal data beyond what is necessary for accessibility

6. Subscription and Billing

  • Paid plans are billed monthly or annually
  • You may cancel at any time; access continues until the end of the billing period
  • We may change pricing with 30 days notice
  • Refunds are available within 14 days of first payment if unsatisfied

7. Service Level

We aim for 99.9% uptime for the AI backend. Compliance-tier customers receive an explicit SLA. The client-side widget continues to serve core controls (text, colour, navigation aids, profiles) even when the backend is unavailable, so your end users are never blocked.

8. Intellectual Property

All components — the widget, engine, AI backend, dashboard, branding, and documentation — are proprietary and owned by Encludo. Access is licensed to you under these Terms for the duration of your active subscription or free-tier registration.

9. Limitation of Liability

Encludo is provided “as is”. While we strive for comprehensive WCAG compliance, we cannot guarantee full legal compliance for your specific situation. Encludo is a tool to assist with accessibility, not a substitute for professional accessibility audits or legal advice.

10. Termination

We may terminate or suspend your account for violation of these terms. You may terminate your account at any time by contacting support. Upon termination, your data will be deleted within 30 days.

11. Changes to Terms

We may update these terms with 30 days notice via email. Continued use of the Service after changes constitutes acceptance of the new terms.
